1. Introduction
These Terms and Conditions govern the use of FlexiSubs subscription services. By applying for or using FlexiSubs, you agree to comply with the terms set out below.
FlexiSubs provides customers with access to selected assets through a structured monthly subscription model, enabling use of products without the requirement for full upfront purchase.
2. Eligibility
To qualify for FlexiSubs services, customers must:
- Be 18 years or older
- Provide accurate personal and contact information
- Provide valid identification documents where required
- Agree to the subscription terms presented at application stage
- Have the financial ability to meet monthly subscription obligations
FlexiSubs reserves the right to approve or decline applications at its discretion.
3. Subscription Model
FlexiSubs offers access to assets through fixed-term or month-to-month subscription agreements.
Key characteristics:
- Customers pay a monthly subscription fee for access to the selected asset
- Ownership of the asset remains with FlexiSubs during the subscription term
- Subscription terms may include 12, 18, or 24 months depending on the product
- Customers may be offered upgrade, renewal, or return options at the end of the subscription period
- Subscription fees include usage of the asset and associated service benefits where applicable
4. Payments
- Subscription fees are payable monthly in advance
- Payments must be made using approved payment methods
- Failure to make payment may result in suspension of the subscription
- Continued non-payment may result in cancellation and collection of the asset
- Fees paid are non-refundable unless otherwise stated
- FlexiSubs reserves the right to adjust pricing with prior notice
5. Use of Assets
Customers agree:
- To use the asset for lawful purposes only
- To take reasonable care of the asset
- Not to resell, sublease, or transfer the asset to another party
- Not to intentionally damage or misuse the asset
- To inform FlexiSubs of any damage or malfunction
Customers may be liable for repair or replacement costs where damage occurs due to negligence or misuse.
6. Upgrades
Where upgrade options are available:
- Customers may request to upgrade to a different product during the subscription term
- Approval of upgrades is subject to eligibility and account standing
- Revised subscription terms and fees may apply
7. Returns
At the end of the subscription term:
- Customers may return the asset in good working condition
- Fair wear and tear is acceptable
- Damage beyond normal wear may result in repair charges
- Customers may be offered renewal or upgrade options
8. Cancellation
Customers may request cancellation subject to the following:
- Notice periods may apply depending on subscription type
- Early termination fees may apply where applicable
- Outstanding amounts must be settled prior to cancellation
- The asset must be returned in acceptable condition
FlexiSubs reserves the right to cancel subscriptions where terms are breached.
9. Limitation of Liability
FlexiSubs shall not be liable for:
- Indirect or consequential damages
- Loss resulting from misuse of the asset
- Interruptions caused by factors beyond reasonable control
Total liability is limited to the value of subscription fees paid.
10. Privacy
Customer information is collected for the purpose of providing services and managing subscriptions. FlexiSubs takes reasonable steps to protect personal information in accordance with applicable data protection regulations.
11. Changes to Terms
FlexiSubs may update these Terms and Conditions from time to time. Customers will be notified of material changes where required.
Continued use of the service constitutes acceptance of updated terms.
12. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
